This Privacy Policy describes Our policies and procedures on the collection, use, storage, and protection of Your information when You use the TrackLabs time tracking and employee monitoring service. This policy tells You about Your privacy rights and how the law protects You.
By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy.
📖 Definitions
Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

- Account means a unique account created for You to access our Service or parts of our Service.

- Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to TrackLabs, an Indian company providing time tracking and employee monitoring software. 
- Customer Data refers to all data that you upload, submit, or transmit through the Service, including employee time tracking data, activity logs, screenshots, and other monitoring information collected through the Service. 
- Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses. 
- Country refers to: Punjab, India 
- Device means any device that can access the Service such as a computer, a cellphone or a digital tablet. 
- Personal Data is any information that relates to an identified or identifiable individual. 
- Service refers to the Application or the Website or both. 
- Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used. 
- Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit). 
- Website refers to Tracklabs, accessible from https://tracklabs.in 
- You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Personal Data

Customer Data (Employee Monitoring Data)
When you use TrackLabs to monitor and track your employees, the Service collects and stores various types of Customer Data on your behalf, including:
- Employee time tracking data (clock in/out times, work hours, breaks) 
- Application and website usage data 
- Activity levels and productivity metrics 
- Screenshots and screen recordings (if enabled by you) 
- Project and task assignments 
- Employee attendance records 
🔐 Data Ownership: You own all Customer Data. We act only as a data processor and store this data securely on your behalf. We do not access, view, analyze, or use your Customer Data for any purpose other than providing the Service to you. Only you and authorized users within your organization have access to your Customer Data.
Usage Data
Usage Data is collected automatically when using the Service.
Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.
We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.

- For customer support: To respond to your support requests, troubleshoot technical issues, and assist you in using the Service effectively.

🤝 Data Sharing Policy
We may share limited Personal Data (not Customer Data) only in the following strictly necessary situations:
- With Essential Service Providers: We work with trusted third-party service providers who help us operate our Service, such as:- Cloud hosting providers (to store data securely)
- Payment processors (to handle subscription billing)
- Email service providers (to send transactional emails)
 
- For Legal Compliance: We may disclose Personal Data if required by law, court order, or government regulation. We will notify you of such requests unless legally prohibited from doing so.
- For business transfers: If TrackLabs is involved in a merger, acquisition, or sale of assets, your Personal Data may be transferred. We will provide notice before your data is transferred and becomes subject to a different Privacy Policy. Customer Data will remain protected under the same privacy standards.
- With Your Explicit Consent: We may share your information for any other purpose only with your explicit permission.
We will NEVER:
- Share your Customer Data with advertisers, marketers, or data brokers
- Sell or rent your personal information or Customer Data to any third party
- Use your Customer Data for our own business purposes beyond providing the Service to you
- Allow unauthorized third parties to access your employee monitoring data
⏱️ Data Retention
We retain your data for different periods depending on the type of data:
- Customer Data: We retain your Customer Data (employee monitoring data, time tracking records, etc.) for as long as your account is active. If you cancel your subscription, we will retain your Customer Data for 90 days to allow for account reactivation. After 90 days, all Customer Data is permanently deleted from our systems. 
- Account and Personal Data: We retain your account information and Personal Data for as long as necessary to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements. 
- Billing Records: We retain billing and payment records for the period required by applicable tax and accounting laws (typically 7 years in India). 
- Usage and Analytics Data: We retain aggregated, anonymized usage data to improve the Service. This data does not contain any personally identifiable information or Customer Data. 
💡 Data Deletion: You can request deletion of your data at any time by contacting our support team. Upon receiving your request, we will delete your Personal Data and Customer Data within 30 days, except where we are required to retain it for legal compliance.

Your Rights: You have complete control over your Personal Data and Customer Data. You have the right to:
- Access: Request access to all Personal Data and Customer Data we hold about you. 
- Correction: Correct any inaccurate or incomplete information in your account. 
- Deletion: Request deletion of your Personal Data and Customer Data at any time. 
- Export: Export your Customer Data in standard formats (CSV, Excel, PDF) at any time through your account dashboard. 
- Restriction: Request restriction of how we process your Personal Data. 
- Portability: Request transfer of your data to another service provider. 
- Object: Object to certain processing of your Personal Data.

Your data is processed and stored on secure servers. While our primary servers are located in India, some of our trusted service providers may operate in other jurisdictions. If you are an employee whose employer uses TrackLabs to monitor your work activities, please note:
- Your employer (the customer) is the data controller of your monitoring data. TrackLabs is only a data processor acting on behalf of your employer. 
- Your employer determines what data is collected, how it is used, and who can access it within their organization. 
- For questions about how your employer uses your monitoring data, or to exercise your privacy rights regarding that data, please contact your employer directly. 
- TrackLabs does not control or access your monitoring data except when providing technical support to your employer. 
- Your employer is responsible for complying with applicable employment and privacy laws in your jurisdiction regarding employee monitoring. 
📢 Data Disclosure
Business Transactions
If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.
Law Enforcement
Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us immediately. If We become aware that We have collected Personal Data from anyone under the age of 18 without appropriate authorization, We will take immediate steps to remove that information from Our servers.
